Terms of Use

Welcome to Tomodachi Miis (“Tomodachi Miis,” “we,” “us,” or “our”). These Terms of Use (the “Terms”) govern your access to and use of the TomodachiMiis.org website and any related applications or services (collectively, the “Service”). Tomodachi Miis is a fan-made community for discovering and sharing Mii character designs for Tomodachi Life: Living the Dream. We are not affiliated with, sponsored by, or endorsed by Nintendo.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service. We may update these Terms from time to time as described in the “Changes to These Terms” section below, and your continued use of the Service constitutes acceptance of any revised Terms.

2. Eligibility

You must be at least 13 years of age to use the Service. The Service is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. By using the Service, you represent and warrant that you are at least 13 years old and that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Accounts

Some features of the Service require you to create an account by registering with an email address and password (or by signing in through a supported third-party provider). You agree to provide accurate and complete information and to keep it up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@tomodachimiis.org of any unauthorized use of your account. We are not liable for any loss arising from your failure to protect your credentials.

4. User-Generated Content

The Service allows you to submit content, including Mii images, screenshots, names, descriptions, tags, and other materials (“User Content”). You retain ownership of your User Content. By submitting User Content, you grant Tomodachi Miis a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, display, adapt, and distribute that User Content for the purpose of operating, promoting, and improving the Service.

You represent and warrant that you own all rights to the User Content you submit, or that you have obtained all necessary rights, licenses, and permissions to submit it and to grant the license above, and that your User Content does not violate the rights of any third party or any applicable law.

5. Objectionable Content & Abuse — Zero Tolerance

We have zero tolerance for objectionable content and abusive behavior. Objectionable content includes, without limitation, content that is unlawful, infringing, defamatory, obscene, pornographic, sexually explicit, hateful, harassing, threatening, violent, or otherwise inappropriate for a community-friendly platform.

Every Mii on the Service can be reported using the in-product “Report” control. We review every report and take action on objectionable content and abusive users within 24 hours. When a report is upheld, the offending content is removed and the user responsible may be ejected from the community. Users who repeatedly or egregiously violate these Terms may be blocked or permanently banned, and their content removed, at our sole discretion and without prior notice.

If you encounter objectionable content or abusive behavior, please report it through the Service or email support@tomodachimiis.org.

6. Prohibited Conduct

When using the Service, you agree that you will not:

• Harass, bully, threaten, or harm any other person.
• Post spam, advertisements, or repetitive, misleading, or low-quality content.
• Upload content that infringes any copyright, trademark, or other intellectual property right.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Upload viruses, malware, or any code designed to disrupt or damage the Service.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Collect or harvest personal information about other users without their consent.
• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.

7. Intellectual Property & Takedown Requests

We respect the intellectual property rights of others and expect users to do the same. If you believe that content on the Service infringes your copyright or other intellectual property rights, please send a takedown notice to support@tomodachimiis.org that includes: (a) identification of the work you claim has been infringed; (b) identification of the allegedly infringing material and its location on the Service; (c) your contact information; (d) a statement that you have a good-faith belief that the use is not authorized; and (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf. We will respond to valid notices and may remove infringing material and terminate repeat infringers.

8. Termination

We may suspend or terminate your access to the Service, remove your User Content, or block or ban your account at any time, with or without notice, if we believe you have violated these Terms or if we determine that doing so is necessary to protect the Service or its users. You may stop using the Service and request deletion of your account at any time by contacting support@tomodachimiis.org. Provisions of these Terms that by their nature should survive termination will survive.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any User Content is accurate, reliable, or appropriate.

10. Limitation of Liability

To the maximum extent permitted by law, in no event will Tomodachi Miis or its operators be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars (US$100).

11. Changes to These Terms

We may modify these Terms from time to time. When we make material changes, we will update the “Effective date” at the top of this page and, where appropriate, provide additional notice. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms.
